General Provisions

The Centrum Ronde van Vlaanderen, electronic web shop, a non-profit organisation with its registered office in Oudenaarde, offers customers the opportunity to purchase clothing and accessories. The buyer accepts that these conditions will be the only ones applicable, to the exclusion of his own general or specific (purchase) conditions, even if these would stipulate that they are the only ones applicable.

Price

All prices stated are always inclusive of VAT and all other taxes to be borne by the buyer. If transport, reservation or administrative costs are charged, this will be stated separately. The stated price refers exclusively to the article as it is described verbatim. The accompanying photo is for decorative purposes only and may contain elements or articles not included in the price.

Offer

Products are only delivered to the countries for which the website allows delivery.

Despite the fact that the webshop and website are compiled with the greatest possible care, the information offered may still be incomplete, contain material errors or be out of date.

As far as the accuracy, updating or completeness of the information offered is concerned, the Vendor is only bound by an obligation of means. Under no circumstances shall the seller be liable in the event of material errors, misprints or printing errors.

The offer is always valid while stocks last and can be amended or withdrawn by the seller at any time.

The seller has the right - without giving reasons - to refuse orders, adjust delivery deadlines, split deliveries or attach other conditions to the delivery.

Retention of title

The delivered goods remain the property of the seller until full payment of the price, including all costs and charges, negligence interest and fees, has been made. In the event of non-payment, the seller reserves the right to take back the goods, ipso jure and at the buyer's expense.

However, the risk due to loss or damage shall pass to the buyer as of delivery. The buyer undertakes to inform third parties of the seller's retention of title if necessary, e.g. to anyone who might come to seize items that have not yet been paid for in full.

Penalties for non-payment

Invoices are payable at the seller's registered office at Markt 43, 9700 Oudenaarde, Belgium, on the due date, net without discount, unless otherwise stated on the invoice.
Any complaint regarding invoices must, in order to be admissible, be formulated in detail by registered letter within three (3) days of receipt of the invoice.

Without prejudice to the exercise of other rights available to the seller, in the event of non-payment or late payment, the buyer shall be liable, ipso jure and without notice, to pay interest of 10% per annum on the unpaid amount from the date of default. Furthermore, the customer shall be liable, ipso jure and without formal notice, to pay a fixed indemnity of 10% on the amount concerned, with a minimum of €25 per invoice.

Without prejudice to the foregoing, the seller reserves the right to take back items that have not been paid for (in full).

Complaints

Any visible damage and/or qualitative deficiency of an item or other shortcoming in delivery must be reported immediately, otherwise any right to compensation lapses:

(a) in case of complaint for non-conforming delivery: eight (8) days after delivery 

(b) in case of hidden defects: eight (8) days after discovery of the defect or after the moment when such discovery could reasonably have been made.

The acceptance of the goods by the buyer covers any possible defect or non-conformity that could then have been detected.

Warranty

Our warranty is limited to the warranty for hidden defects and the warranty in case of consumer purchases, both provided for in the Civil Code.
The warranty never applies to damage resulting from accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, modifications or alterations to the item, heavy-handed use, poor maintenance, abnormal or incorrect use.
The warranty is not transferable.

Force majeure

The seller shall not be liable for any delay in the performance or non-performance of our commitments due to events beyond its normal control, including production interruptions, difficulties in supplying or shortages of raw materials, labour, energy or transport or delays in transport, strikes, lock-outs, work interruptions or other collective labour disputes affecting either ourselves or our suppliers, even if these events are foreseeable.

Right of withdrawal

Purchasers have the right to abandon their purchase, without payment of a penalty and without giving a reason within 14 days from the day following delivery of the product.Purchasers wishing to exercise the right of withdrawal must contact the seller's customer service department (see article 13) within 14 days from delivery and return the goods to the seller within 14 days from delivery of the goods.

Goods shall be returned using the return ticket provided for this purpose. 

Only items in their original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase will be taken back.

As soon as we have received the items back, we will refund the amount of the returned goods.

Under no circumstances will we take back
- used, soiled, damaged or incomplete items
- items whose labels have been removed
- articles that have been custom-made for the customer
- items that cannot be returned due to their nature

Personal data

Door te bestellen op de internet site van de Rondeshop.be, stemt de koper uitdrukkelijk in met de verwerking en het gebruik van zijn/haar persoonsgegevens voor doeleinden zoals de administratie van het klantenbestand, het beheer van de bestellingen, leveringen en facturen, het opvolgen van de solvabiliteit, marketing en reclame. De verwerking voor marketingdoeleinden en de geïndividualiseerde reclame gebeurt enkel indien de klant zich hiertoe uitdrukkelijk akkoord heeft verklaard tijdens het orderproces. Het Centrum Ronde van Vlaanderen VZW  zal de gegevens niet overmaken aan derden. De koper heeft voor alle gegevens het recht op inzage en verbetering. De koper heeft ten allen tijde het recht om zich kosteloos te verzetten tegen de verwerking voor direct marketing doeleinden. 

Infringement of validity

If any article of these terms and conditions is declared null and void, this invalidity shall not affect the validity of the remaining articles.

Modification of conditions

Modification of conditions

These conditions are supplemented by other conditions explicitly referred to and the seller's general conditions of sale. In the event of contradiction, these conditions shall prevail.
The seller can always change these conditions without further notice. Any purchase after the amendment implies acceptance by the buyer of these new conditions.

Proof

Within the framework of their relations, all parties accept electronic evidence (for example : e-mail, backups, ...).

Applicable law - competent court

HBelgian law shall apply, with the exception of the provisions of international private law on applicable law and with of the Rome I Regulation on international sales contracts relating to movable property. In the event of any disputes, the courts of Ghent shall have exclusive jurisdiction.

IIntellectual property rights 

The entire Rondeshop website including texts, photos, images, moving images, sounds, illustrations and software are our property or the property of related companies, licensees and/or content providers. They are protected by copyright, trademark, and all other forms of intellectual property law. They may only be used with the permission of the Ronde van Vlaanderen Centre.

Limited liability 

The seller is in no way liable for viruses or damage to your computer, telecommunications equipment or other property as a result of visiting or using this website, or downloading material from this website.
